| Kick Back Tent Trailer Rental Agreement Terms & Conditions Please read the following Trailer Rental Terms and Conditions carefully. It forms any rental agreement you make with Kick-Back Tent Trailer Rentals. Terms and Conditions & Rental Prices are subject to change without notice. 1.Rental Payment: Reservations are recommend 30 days prior to departure, A $ 250.00 deposit is required to hold any trailer; Payments must be made in person. The balance of the rental is due on the day of pick-up 2. Cancellation Fee: Cancellations must be submitted in writing, if the rental is canceled within two weeks of the departure date, renter forfeits 50% of the down payment. If renter is a no show or cancels one week prior, there will be no refund. The security deposit will be refunded the same way it was paid. 3. Rental Floor Plans: Reservations are made by floor plan only not by year, make or color. Kick Back Tent Trailer rental will do it’s best to accommodate you with the best floor plan that you have chosen. Kick-Back Tent Trailer Rental reserves the right to substitute trailers of similar or higher grade. Should a floor plan of lower grade be offered and accepted, liability will be limited to refund of price differential between models paid for and model taken. 4. Contract Changes: Renters are allowed to make one change on their contract at no cost if the change is done no less than 7 days before the departure to avoid a penalty. If the change is made with in 7 days of the departure date there will be a $ 25.00 penalty fee. If renter reschedules on the day of their original pick up date, renter will forfeit $100.00. No Exceptions. If renter cancels rescheduled dates, renter will forfeit rental payments. 5. Delivery/Pick up: If you would like a Kick-Back Tent Trailer driver to deliver and pick up your rental to you, a charge of $ 25.00 in town (only) will be charged. 6. Preparation: Please allow yourself enough time prior to pick up for a complete walk through, instructions and set-up of the trailer, the check in and check out process can take up to 1 hour each. 7. Returning: Renter agrees to return Rentals between 9:00 am and 11:00 am (Monday – Saturday) Renter agrees to pay a late fee of $ 25.00 per hour for every 1 hour past 11:00 am to a maximum of $ 250.00. There are no refunds for early returns. The trailer must be returned clean inside and out before returning. (See cleaning policy) If the trailer is not returned clean inside and out a $ 25.00 cleaning fee will be charged. 8. Rental Day: The rental day is based on the number of nights the trailer is used, 1 night equals 1 day rental. 9. Pet Policy: No Pets welcome here, a $ 50.00 cleaning fee will be charged if trailer is returned with pet hair or pet odor. (See Cleaning Policy) 10. Smoking: For the Safety of our customers and their family there is NO Smoking in any Trailer rented from Kick Back Tent Trailer Rentals int.______ 11. Renter Damage: If the trailer is returned with damage while the trailer is in possession of the renter, renter is responsible to pay all damage costs whether the renter was at fault or not or if the damage was caused by acts of nature (Wind, Rain, Hail, Fire, Flood etc.) If an accident does occur the renter is responsible for obtaining a police report, contacting the renter’s insurance company and contacting Kick Back trailer Rental Company immediately. Renter(s) whose name appears on the contract are the only authorized drivers to tow the trailer 12. Insurance for Trailers: Renter must have liability insurance coverage on their tow vehicle that will extend to the trailer. Renter must provide Kick Back Trailer Rentals with an insurance binder that shows liability coverage extending to the trailer. It is the renter’s responsibility to contact their insurance company for the insurance binder and to give the insurance company the information on the trailer they are renting. Renter must call Kick Back trailer Rentals before their departure to acknowledge receipt of the insurance binder. The renter cannot leave with the rental trailer unless the insurance binder has been received and is acceptable by Kick Back Trailer Rentals 13. Early Returns/Extending Rental Days: Renter is responsible for reading over the rental contract to ensure that all rental costs and rental date are correct before they depart. If the renter wishes to extend their rental dates, renter must call Kick Back Tent Trailer Rentals for approval. There are NO refunds for early returns. If renter does not return on their scheduled date and has not called Kick Back Trailer Rental for approval to extend, renter will be charged $ 25.00 plus additional rental day (s). 14. Parking/Traffic Violation: Renter is responsible for reporting and payment of any and all parking/traffic violations at rental return. Non-reporting of such violations breaches the rental contract and may result in an administrative charge of up to $ 100.00 in addition to the fines. 15. Late Pick Ups: No refunds will be given for late pick ups. 16. WAIVER OF LIABILITY: In consideration of being allowed to rent a camper the undersigned expressly waives and releases its owner, its administrators, directors, agents, officers, and employees, from any and all causes of action or claims whatsoever, of any kind or nature, arising from, or in any manner related to, customer's rental and use of the camper. This Waiver and release shall insure to the benefit of the assigns or successors of owner and shall be binding upon the heirs or successors of customer. Customer specifically understands that use of the camper is at customer's own and sole risk. Customer specifically acknowledges his experience and capabilities and believes he is qualified to use and operate the camper. Customer fully understands that use of the camper involves risks and dangers and may result in serious bodily injury. Customer understands that his own actions, or inactions, the actions or inaction of others or the negligence of the releases may cause such risk and dangers. With full knowledge, the customer fully accepts and assumes all such risks and all responsibility for losses, costs, and damages incurred as a result of his use of the camper, of any kind or nature whatsoever. Customer further agrees that if, despite the release, he or anyone on his behalf makes a claim against any of the releases named herein, customer will indemnify, save and hold harmless each of the releases from any litigation expenses, attorney's fee, loss liability, damage or cost any may incur as a result of any such claim. Customer acknowledges that he has read this release, fully understands its terms, understands that he has given up substantial rights by signing it, and has signed it freely and without any inducement or assurance of any nature, and intends same to be a complete and unconditional release of all liability to the greatest extent allowed by the law of the state in which such activity is conducted and further, agrees that if any portion of this release is held to be invalid that the balance, notwithstanding, shall continue in full force and effect.
